Now his lawyers are asking a judge to reconsider the sentence, saying the lengthy jail term bars him from leading the kind of “humane lifestyle” afforded to inmates in state prison.

Bollaert, 29, ran a website called UGotPosted.com, where users were invited to post nude or otherwise intimate photos of women and men, along with their names, the cities in which they lived and worked, and other personal identifying information.

from berkshireeagle.com – A former New York Jets linebacker has pleaded guilty to three charges in connection with a domestic dispute that invoked New Jersey’s “revenge porn” law.

Jermaine Cunningham is expected to be sentenced to probation in June.

The 26-year-old Cunningham pleaded guilty Wednesday in state Superior Court to invasion of privacy, illegal transport of a weapon and possession of hollow-point bullets.

Authorities say the charges stemmed from a domestic dispute at a residence in Summit on Dec. 29. A loaded handgun was found in Cunningham’s car. Investigators say Cunningham also posted a racy photo of his estranged girlfriend online without her consent.

Cunningham is an NFL free agent who was with the Jets last year.

California Attorney General Kamala Harris said 28-year-old

of Tulsa pleaded no contest on Friday to charges of extortion, attempted extortion and conspiracy.

The attorney general’s office says Meyering operated a website called Winbystate.com that encouraged visitors to post nude photos of “your ex-girlfriend, your current girlfriend, or any other girl that you might know.” More than 400 images were on the site’s California forum.

Jermaine Cunningham, a free agent who was with the New York Jets last year, is charged with invasion of privacy, unlawful weapons transport and possession of hollow-point bullets. The 26-year-old pleaded not guilty in January and now has a week decide whether to plead guilty to the charges or go to trial.

Authorities say the charges against Cunningham stem from a domestic violence incident at a Summit residence on Dec. 29. A prosecutor’s spokesman says a loaded handgun was found in Cunningham’s car.

Attorney General Kamala Harris said Friday that Kevin Bollaert’s sentence shows there are severe consequences for exploiting people online.

Bollaert was convicted in February of identity theft and extortion in San Diego Superior Court.

“I couldn’t breathe for a little while,” said Hellstrom on Monday, remembering the first time she learned of the photos.

“I’m a very bright girl, but I made a very stupid mistake,” she said. “I never thought that it would spiral down like this and go viral like it did.”

Hellstrom, 22, now finds herself an activist lobbying the Florida Legislature for criminal penalties for revenge porn, posting online nude or sexually explicit photos that were originally meant to be kept between two people. The laws aren’t on the books, but Hellstrom’s personal “nightmare” has given her the energy to make sure laws are enacted one day.

from theverge.com – The former operator of a revenge porn website banned by the Federal Trade Commission (FTC) has invoked copyright law in an attempt to remove “unauthorized photos” of himself from the internet. Craig Brittain, who previously ran the site IsAnybodyDown.com, has filed multiple takedown notices to Google under the Digital Millennium Copyright Act (DMCA). Brittain is asking that the internet giant remove search results pointing to 23 sites that wrote about the FTC’s decision against him (including The Verge), arguing that they include “unauthorized information” about him as well as “photos which are not ‘fair use.'”

The staggering irony of the situation is hard to ignore. The FTC originally stopped Brittain’s revenge porn business in January this year, banning him from “publicly sharing any more nude videos or photographs of people without their affirmative express consent.” The agency’s complaint alleged that he not only “used deception to acquire and post intimate images of women,” but also operated a fake “takedown” service, charging individuals between $200 to $500 to have their pictures removed from his site. “Despite presenting these as third-party services, the complaint alleges that the sites for these services were owned and operated by Brittain,” said the FTC. The director of the FTC’s Bureau of Consumer Protection added that Brittain’s behavior was “not only illegal but reprehensible.”

Hunter Moore, of Woodland near Sacramento, will enter his plea to one count each of unauthorized access to a protected computer to obtain information and aggravated identity theft at a date to be scheduled, according to the plea agreement.

Moore allegedly paid co-defendant Charles “Gary Jones” Evens upwards of $200 a week to break into women’s email accounts and steal nude photos of them, which were posted on his now-defunct site IsAnyoneUp.com?

Evens, 26, of Studio City is currently set to go on trial in Los Angeles federal court on March 17.

Kevin Bollaert, 28, was found guilty Monday of identity theft and extortion. He faces up to 20 years in prison.

The San Diego County Superior Court jury was unable to reach verdicts on two charges of identity theft and conspiracy and a judge declared a mistrial on the counts.

It was believed to be the first conviction of a revenge porn website operator, although two months a Los Angeles man who posted a topless photo of his ex-girlfriend on Facebook was sentenced to a year in jail for violating California’s new revenge porn law.

The FTC says Craig Brittain of Colorado Springs, Colo., ran the website isanybodydown.com, which is no longer operational. Officials say the site worked like this: A man would obtain the images while dating the woman. But upon breaking up, the woman’s ex would supply the photos to Brittain, who would post them along with the woman’s full name, age, home town, phone number and link to her Facebook profile. The FTC says Brittain advertised a separate legal service that claimed to be able to take down the photos for a fee of up to $500.

Kevin Bollaert is facing felony counts of conspiracy, identity theft and extortion. Prosecutors say he posted thousands of nude photos of women online, then charged them to take them down.

After hearing from both attorneys, the judge ruled Monday that there is enough evidence to go to trial.

“I believe that the evidence from all of those sources showed that the defendant willfully obtained the victim’s private photos and their information and used that material to annoy and harass,” the judge said.

Bollaert will be back in court on January 5. His trial is set to begin on January 12.

According to State Senator Anthony Cannella, who sponsored the legislation, the modified law would include a “selfie,” but further explanation seems to be order.

SB1255 makes it a crime to intentionally distribute images of another identifiable person’s intimate body parts. Now, it doesn’t matter who takes the image. The key issue is only whether there’s an agreement or understanding “the image shall remain private, the person distributing the image knows or should know that distribution of the image will cause serious emotional distress, and the person depicted suffers that distress.”
